End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you and StackCheck, operated by Alchemy Digital ("we", "our", or "us"), governing your use of the StackCheck mobile application and any related services (together, the "Licensed Application"). By downloading, installing, or using the Licensed Application, you agree to be bound by this EULA. If you do not agree, do not download, install, or use the Licensed Application.

This EULA is concluded between you and StackCheck only, and not with Apple. StackCheck, not Apple, is solely responsible for the Licensed Application and its content. This EULA does not provide for usage rules for the Licensed Application that conflict with the Apple Media Services Terms and Conditions; in the event of a conflict, those terms and the App Store Usage Rules prevail.

1. Scope of License

We grant you a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions. The license is limited to your personal, non-commercial use. You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute, or sublicense the Licensed Application and, if you sell your device to a third party, you must remove the Licensed Application from it first.

You may not copy (except as expressly permitted by this license and the Usage Rules), decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof, except to the extent this restriction is prohibited by applicable law or permitted by the licensing terms governing any open-source components included with the Licensed Application.

2. Description of Service

StackCheck is a mobile application that helps users track their food intake and supplements to understand their nutritional profile. The Licensed Application uses AI-powered image recognition to identify foods and estimate nutritional content, and provides personalized insights based on the information you provide.

3. Not Medical Advice

AI-powered food recognition and nutrient calculations are estimates and may not be completely accurate. Always consult a qualified healthcare provider before making changes to your diet or supplement regimen. Do not disregard professional medical advice, or delay seeking it, because of information provided by StackCheck. You should not rely solely on StackCheck for critical health decisions.

4. Maintenance and Support

StackCheck is solely responsible for providing any maintenance and support services for the Licensed Application, as specified in this EULA or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application. 5. Subscriptions and Payments

StackCheck offers both free and premium ("Pro") features. Premium subscriptions are auto-renewable and are processed through the Apple App Store or Google Play. By subscribing, you also agree to the applicable app store terms and payment policies.

• Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually) and renew automatically unless cancelled at least 24 hours before the end of the current period.
• Cancellation: You may cancel at any time through your app store account settings. Access continues until the end of the current billing period.
• Refunds: Refund policies are governed by the Apple App Store or Google Play terms.

6. Warranty

StackCheck is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. The Licensed Application is otherwise provided "as is" and "as available" without warranties of any kind, and we do not warrant that it will be uninterrupted, error-free, or completely secure.

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be StackCheck's sole responsibility.

7. Product Claims

StackCheck, and not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of it, including but not limited to: (a) product liability claims; (b) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application's use of any third-party health or fitness frameworks.

8. Intellectual Property Rights

The Licensed Application, including its design, features, content, and underlying technology, is owned by StackCheck and protected by copyright, trademark, and other intellectual property laws. In the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, StackCheck, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

9. Acceptable Use

You agree not to:

• Use the Licensed Application for any unlawful purpose
• Attempt to reverse engineer, modify, or hack the Licensed Application
• Upload malicious content or attempt to disrupt the service
• Create multiple accounts to abuse free features
• Resell or redistribute the Licensed Application or its content

10. Legal Compliance

You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

11. Limitation of Liability

To the maximum extent permitted by law, StackCheck and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill; health issues arising from reliance on information in the Licensed Application; service interruptions or data loss; or actions taken based on nutritional recommendations. Our total liability shall not exceed the amount you paid for the Licensed Application in the 12 months preceding the claim.

12. Termination

This EULA is effective until terminated by you or StackCheck. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Licensed Application and delete all copies.

13. Third-Party Terms and Beneficiary

You must comply with applicable third-party terms of agreement when using the Licensed Application. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

14. Governing Law

This EULA is governed by the laws of Australia, without regard to its conflict-of-laws provisions. Any disputes shall be resolved in the courts of New South Wales, Australia. This choice of law does not restrict any statutory consumer protection rights that apply to you in your country of residence.

15. Changes to This EULA

We may update this EULA from time to time. We will notify you of material changes via the Licensed Application or email. Continued use after changes take effect constitutes acceptance of the updated EULA.
